FULL TERMS AND CONDITIONS

Our Terms and Conditions comply with UK legislation including the Distance Selling Regulations 2000. The Terms and Conditions are designed so that all customers can shop easily and with confidence with MonitorMyBaby.

The following are the terms and conditions for the sale of goods, which apply to and govern any contract, which we enter into with you. Please read them carefully. An offer to buy goods is conclusive evidence of your acceptance of the following terms and conditions.

These terms and conditions do not affect your statutory rights.

1. We will treat each order for goods as an offer by you to buy them subject to these terms and conditions.

2. We have the right at our discretion not to accept any order. If we do not supply goods for any reason we will not charge you for them and we will refund any money already paid for them. We will not compensate you for any other loss which you may suffer if we do not supply goods.

3. If we elect to accept your order we will notify you accordingly. It is only when you receive such notification that a binding contract is concluded with you on these terms and conditions.

4. The price for the goods will be as quoted on our web site at the time you place your order, but we reserve the right to remedy an obvious mistake in pricing by charging a proper commercial price to rectify such a mistake.

5. Goods are subject to availability and delay in delivery of goods is sometimes out of our control. Deliveries will normally be made within 2 working days. If delivery cannot be made in this time, we will contact you to discuss alternative arrangements. You have the right to withdraw from the contract at this stage and be entitled to a product exchange or refund.

6. As soon as the goods have been delivered you will be responsible for them. Delivery is deemed to take place when the goods are delivered to the address nominated by you. However, you will only own the goods when we have received payment for them in full.

RETURNS

7. If goods are delivered to you in a damaged condition you must inform us as soon as possible by emailing customerservices@monitormybaby.co.uk or calling 020 8675 0771 . Please retain the original packaging for returning your order. We will arrange for a prompt replacement.

8. We are prepared to offer a refund on any goods purchased, providing confirmation is received by us within 7 working days of you receiving the goods. Following this the unused goods must be returned, at the customer's expense, within the 7 days of the notice to cancel. Items should be unopened and in the original packaging. You will receive a refund once we have checked that the item is in good condition. If the item is not 'as new' a refund will be given of the approximate resale value. We also reserve the right to charge a restocking fee of up to 15% of the order value. If we do not receive the goods back we will deem that you have accepted the goods and no longer wish to cancel the order.

9. If you suspect a fault with your product please call the technical helpline number associated with the manufacturer of your goods, this number can be found in the product literature. If there is an obvious defect and/or under the manufacturers recommendation it needs to be returned, please notify us and return the goods to us within the 28 days of receipt.

10. Within 28 days of purchase, if your goods develop a fault we will offer a prompt replacement of the relevant components. This does not apply to faults caused by accident, neglect or misuse. A replacement will only be issued when the faulty item is returned in ‘as new' condition. We must be notified of the fault within 28 days of purchase and proof of purchase must be provided

11. All baby monitors are supplied with a year's warranty. If your purchase develops a fault after 28 days and within its warranty period we will arrange to repair and return the product. The baby monitor will need to be returned at the customers expense. This does not apply to faults caused by accident, neglect or misuse. After 28 days you can also return your faulty goods directly to the manufacturer if this is provided for in the literature you received with the product.

12. Batteries of any type, or other perishable items, are excluded from the warranty.

13. Goods returned to us remain at your risk until received by us. We recommend that when returning goods that adequate insurance is taken out to cover any loss or damage that may occur during transit. We will not be held liable for any such loss or damage.

14. If the customer or recipient refuses delivery of their order AOME Ltd reserves the right to charge a restocking fee of up to 15% of the order value. A customer or recipient who is not present on their original (first) delivery attempt and does not organise with the delivery company a successful subsequent (second) delivery date or depot pickup is also deemed to have refused their order delivery.

 

15. Delay or failure by us to exercise any of our rights under these terms and conditions should not be regarded as a waiver of them, nor will any single exercise of such rights preclude any other or further exercise of them.

16. These terms and conditions shall be governed by the laws of England and Wales and any dispute will be resolved exclusively in the courts of England and Wales .

These terms and conditions are subject to change at any time and appropriate notice will be provided on this site of any such changes.
